Terms of service

Bloomly generates AI-designed bouquets, centerpieces and 30-second tutorial reels. Bloomly is content software. Bloomly does not sell, ship or deliver flowers. Bloomly is not a florist, a wedding planner, a wedding-contract guarantor, a veterinarian, or a medical practitioner. Designs are guidance only.

You must be at least 18 years old to use Bloomly. You are responsible for keeping your sign-in credentials confidential and for all activity on your account. Notify us at support@kpsellect.com of any unauthorised access.

You agree to use Bloomly only for lawful purposes and in accordance with our Acceptable Use Policy. In particular, you agree not to: (a) impersonate a real florist, studio or wedding planner; (b) request designs intended to harvest protected wild species or species restricted in your jurisdiction; (c) use Bloomly to misrepresent yourself as the agent of any real wedding, funeral or event without that party's authorisation; (d) submit content that violates the rights of others.

Paid plans (Florist, Studio) and credit packs (Petite, Hand-tied, Wedding bundle) are billed by Stripe in United States dollars. Subscriptions auto-renew until cancelled. You may cancel any time from the customer portal. Credits are a usage allowance and are not redeemable for cash. Statement descriptors are written as "BLOOMLY AI" — not as a flower-delivery merchant.

Subscriptions are refundable within 7 days of a billing cycle, pro-rated against credits already spent. One-off credit packs are refundable for unused credits within 14 days of purchase. See the full refund policy.

Anything you submit (briefs, photos) you keep. You grant Bloomly a worldwide, non-exclusive licence to process your inputs to generate designs and reels for you. Bloomly-generated outputs (designs, reels, PDFs) are licenced to you under the Content Licence and may be used personally and to brief a real florist. See the content licence for re-use limits.

Generated designs may include flora that is out of season, regionally unavailable, allergenic or pet-toxic. Bloomly flags these where it can but cannot guarantee accuracy. Always confirm with a local florist or veterinarian. Read the AI disclaimer.

You may close your account at any time at support@kpsellect.com. We may suspend or terminate accounts that violate these terms or applicable law, or that pose a risk to other users. Upon termination, sections that should reasonably survive (intellectual property, disclaimers, indemnity, governing law) survive.

Bloomly is provided "as is". To the maximum extent permitted by law, Cleveland Hassell Florist, Inc. disclaims all warranties (express, implied, statutory). Our aggregate liability for any claim is limited to the amount you paid Bloomly in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

You will indemnify Cleveland Hassell Florist, Inc. against claims arising from your use of Bloomly in violation of these terms or applicable law.

These terms are governed by the laws of the State of Florida, United States of America, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Pinellas County, Florida, except where consumer-protection law gives you the right to bring a claim in your home jurisdiction.

We may update these terms. Material changes are announced by email and take effect 14 days after notice.
